A landlord tenant dispute can occur no matter how much detail is set forth in an agreement or lease. Many times, eviction notices such as notices to cure or notices of default, notices to quit, notices of termination and nonpayment and holdover petitions are necessary to enforce an owner or landlord’s rights.

Rent Control, Rent Stabilization and the Loft Law are a complicated maze of statutes favoring the tenant and present obstacles for an owner or managing agent. Luxury decontrol is currently a hot-button issue in New York, as it is a legislatively created mechanism that can removes some apartments from the protections of the Rent Stabilization law. Landlords benefit from this because they no longer have to determine artificially lowered rent within a legal framework.
